Workers' comp commission approves raise to weekly compensation rate for 2012
The South Carolina Workers' Compensation Commission approved a 3% increase in the maximum weekly compensation rate for injured workers. An injured worker making the maximum weekly benefit on workers compensation is now entiteld to $725.47 per weekfor injuries or accidents that occur on or after January 1, 2012.
The maximum compensation rates for preceding years are as follows:
January 1, 2011 $704.92
January 1, 2010 $689.71
January 1, 2009 $681.36
January 1, 2008 $661.29
January 1, 2007 $645.94
January 1, 2006 $616.48
What is a compensation rate?
"Generally", a compensation rate is 2/3 of your average weekly wage or pay for the 4 quarters before your injury not including the quarter in which your workers compensation injury occurred. In addition, this includes all pay not just the pay for the employer where the injury occurred so if an injured employee works two jobs this may count towards the average weekly wage and compensation rate. The compensation rate cannot exceed those dollar amounts above for the given year. It is imperative that the compensation rate be correct as it is the basis for any award for an on the job back injury, brain injury, knee injury or any other on the workers compensation injury in South Carolina.
