<h3>Do Weekly Payments Stop if the Doctor Releases Me to Light Duty?</h3>

<p style="text-align: justify;">Sometime yes and sometimes no.&nbsp; If a doctor releases you to return to work and the employer can accomodate you at the same hours, same pay, etc. before the injury then the employer may be entitled to stop your benefit after 150 days of being paid benefits stopping benefits requires your consent through a Form 17 or a Commissioner ordering that the benefits may stop.&nbsp; If the employer cannot accompdate your work restrictions then you may be entitled to the insurance carrier making up the difference between your pre-injury pay and your current light duty pay.</p>

<h3>What is a Compensation Rate and How is My Weekly Payment Determined?</h3>

<p style="text-align: justify;">Generally speaking, a compensation rate is 2/3 of your weekly income for the year preceding the injury not to exceed the maximum comp rate for the year of the injury. <p style="text-align: justify;">At first blush, most people would argue that adultery is very relevant to deciding child custody in South Carolina.&nbsp; If a parent is going to make a bad decision such as that shouldn't it also be assumed that there is the chance that they will make a bad decision later related that could put the child at risk or at least teach them an inappropriate behavior.</p>

<h3>South Carolina Adultery and Custody Law</h3>

<p style="text-align: justify;">Generally, a South Carolina family law attorney or judge in family court does not consider adultery as a primary factor in addressing custody issues.&nbsp;&nbsp; In&nbsp; South Carolina, adultery and custody case of <strong><em>D</em><em>avenport v. Davenport</em></strong>, the mother of the child committed adultery and the boyfriend spent five nights with the mother while the chidlren were present.&nbsp; The Court still awarded the mother custody of the children despite this behavior which could be perceived as risky or immoral.&nbsp; The Court justified their reasoning so as to say that child custody is granted to a party not to reward one party or punish the other.&nbsp;&nbsp; This was recently upheld in 2011 when the Court of Appeals reversed a decision to give a father primary custody and instead gave it back to the mother that had an affair. See <strong><em>Moeller v. Moeller,</em></strong> 394 S.C. 365, 714 S.E. 2d 898 (Ct. App. 2011).&nbsp; The Courts seem to be of the opinion that moral choices are only relevant in in caes where it affects the welfare of the child.&nbsp;&nbsp; <strong><em>Stroman v. Williams,</em></strong> 291 S.C. 376, 353 S.E.2d 704 (Ct. App. 1987).</p>

<p style="text-align: justify;">For the life of me, I cannot understand why in an admitted case, an employer or carrier would delay medical treatment.&nbsp; Delaying medical treatment can increase the potential for an unsuccessfull result or a worsening of a medical condition.&nbsp;&nbsp; For the most part, injured employees want to get back to work if at all possible.&nbsp; With that in mind, they want to get the medical treatment they need and get back to work.&nbsp;</p>

<p style="text-align: justify;">Recently a client came to us and hired me because his treating doctor had recommended physical therapy for his <a title="Workers Comp Back Injuries" href="/Catastrophic-Injuries/Neck-and-Back-Injuries.shtml">workers compensation back injury</a> but it had not been approved going on five (5) months. Now without the benefit of the required medical treatment, his condition has worsened and he is going to be seen by a neurosurgeon for potential surgery as the condition has worsened.&nbsp;&nbsp;</p>

<p style="text-align: justify;">In 2007 the South Carolina legislature passed a new workers' compensation law dealing with <a title="Repetitive Trauma Lawyer Spartanburg Anderson, SC" href="/Workers-Compensation/Repetitive-Trauma-Injuries.shtml">repetitive trauma injuries</a> like carpal tunnel syndrome, repetitive back injuries or cumulative injuries to body parts. &nbsp;When the law was enacted the statute said that an employee with carpal tunnel or any other repetitive trauma injury must report the injury within in 90 days from the date the employee knew or should have known they had a <em>compensable</em> injury. &nbsp; This law was vague as it required an employee to report an injury within 90 days but it was debatable when the 90 days began. Was it 90 days from the date of diagnosis by a medical doctor? &nbsp;Was it 90 days from the date the employee first experience pain? &nbsp;Was it 90 days from the last day the employee was exposed to the job that caused the repetitive injury?</p>

<p style="text-align: justify;">The South Carolina Court of Appeals recently defined when an employee must report a workers' compensation repetitive trauma back injury, carpal tunnel or any other repetitive trauma injury. &nbsp;In the case of <a title="Carpal Tunnel Lawyer Greenville, SC" href="http://www.sccourts.org/opinions/displayOpinion.cfm?caseNo=4895" target="_blank">King v. International Knife and Saw</a> &nbsp;the South Carolina Court of Appeals stated reporting a repetitive injury is not triggered by the onset of pain. The Court went on to say</p>

<p>Currently, road tests focus on neighborhood driving and maneuvers like parallel parking and three-point turns. While most people will need to parallel park eventually, some say that only testing new drivers' abilities in neighborhoods is not an accurate indicator of how they will perform in busier areas.</p>]]>
        <![CDATA[<p>The DMV is now planning new driving tests that will take license applicants on busier streets like highways. Officials say they want new drivers to experience conditions similar to rush hour traffic, in which roads are more hectic than those in quiet neighborhoods. They hope it will prepare drivers to be able to react quickly to inevitable hazards that may occur on South Carolina roads.</p>
<p>DMV officials expect the new testing standards as well as a new grading system&nbsp;to be implemented sometime this summer. They hope to give drivers the necessary skills and knowledge to operate their vehicles safely on the state's roadways.</p>
<p>Inexperience is just one of many factors that can lead to a serious car accident. Hopefully, though, giving new drivers the tools they need to drive safely will help prevent future accidents in Greenville and throughout South Carolina.</p>

<p>Depression, anxiety or other psychological injury can occur on the job or can arise out of another work related injury. Often times, mental injuries are overlooked because a physician is treating the particular locaiton of an injury and not the big picture as to how the pain, fatigue and other symptoms affects a person's psyche. <p><strong>Workers' compensation recognizes two types of mental injuries</strong></p>

We often see this in the form of post traumatic stress disorder (PTSD). In order for this type of injury to be work related, it must arise out of extraordinary employment conditions. The normal work environment is not enough. We often see these type of injuries arising out of a robbery or attack, a horrific car accident, targeted harrassment by a supervisor and so on. These are just a few of the examples and each case is fact specific with the key compenent being <em>unusual and extraordinary circumstances</em>.</p>

<p><strong>2. </strong><strong>Physical - Mental Claims </strong>- When a person has a physical injury such as a back injury, neck injury or other work injury they can experience symptoms of pain and fatigue. Often this leads to an inability to work, provide for their family, or simply do the normal daily tasks we all take for granted. As a result of this, employees can begin to show signs of loss of appetite, increased fatigue, increased irritability, upset "nerves", short temper, and/or an overall feeling of worthlessness. This depression or anxiety arises out of or flows from the physical injury and could be covered under workers' compensation law in South Carolina.</p>

<p>In 2007, South Carolina Workers' Compensation law began to recognize the shoulder as a scheduled member or body part under the Workers' Comp Act. The shoulder, if you had a total loss, is worth up to 300 weeks of compensation according to Section 42-9-30.</p>

<h2>Rotator Cuff Surgery Affects More than the Shoulder</h2>

<p>If surgery is required for a work related rotator cuff tear or an on the job shoulder injury then the injury can go beyond just an injury to the shoulder.&nbsp; Typically once an injured employee has reached maxmimum medical improvement (MMI) the doctor will assign an impairment rating.&nbsp; This will most likely be to the shoulder.&nbsp; However, during a rotatory cuff surgery it is very common for the orthopedic surgeon to shave down the acromioplasty or AC Joint or the distal clavicle or the scapula or all of the above.</p>

<p>Accroding to South Carolina Workers' Compensation law the clavicle and the scapula or body parts recognized for which compensation may be provided.&nbsp; In addition, to the shoulder rating an injured employee with a shoulder injury could receive compensaton for the scaupula (anywhere from 10-100 weeks of compensation) and compensation for the scapula (anywhere from 10-200) weeks of compensation.&nbsp; Simply agreeing that a rotator cuff injury is an injury to the shoulder and nothing else, could leave medical and financial compensation on the table.&nbsp;</p>
