1998 article: Judges discuss misuse of the Order of Protection process

gavel.jpgIn a previous blog post, I had written about the possibility of someone manipulating the Order of Protection process to gain an advantage at the outset of a custody action.  Filing for an Order of Protection usually results in an emergency hearing in Family Court, within a matter of days.  A 1998 AP article elaborates on the process of emergency hearings on requests for Orders of Protection:

A Kentucky man, Richie Farmer, (former Kentucky Commissioner of Agriculture and former University of Kentucky basketball player) is seeking a reduction of his monthly child support.  He currently owes $1,227 monthly to his ex-wife, but claims that he cannot find work.  Under his leadership, the Office of Agriculture was the subject of an audit which prompted legal and ethics investigations.  Now he claims nobody will hire him with the investigation hanging over his head.

Indian man in New Jersey wants child sent to India; asks for help from India's government

An Indian man and his wife had their son taken from them by New Jersey's child welfare services after the child was taken to the hospital for injuries sustained in a fall.  There are now allegations that the parents have not given proper care to the child, due to previous injuries discovered in a CT scan of the child.

Deported Mexican man wins custody appeal in Idaho case

mexico-flag.gifA Mexican man who was deported from Idaho has won custody of his three year old child.  The Idaho Supreme Court ruled that the lower court erred in terminating his parental rights while he was in Mexico and unable to return to the United States to get his child.  In late August 2012, the child was flown to Mexico to be reunited with her father.
